2. Eligibility and Business Use

• It does not guarantee that the same workflow is suitable for every brokerage.
• The user may ask for the call to end.
• BuildFocus Digital may decline or discontinue a demonstration.

5. Phone, SMS and Email Communications

By submitting contact information and the required consent:

• The user requests contact regarding the BuildFocus Digital enquiry.
• Contact may occur by telephone, AI-assisted call, SMS or email.
• Communications may include demonstration calls, appointment confirmations, reminders and service-related follow-up.
• Message frequency may vary and standard carrier charges may apply.
• Consent to marketing may be withdrawn.

Opt-out methods:

No cancellation fee applies to free strategy calls.

For clients that proceed with paid implementation, they may be responsible for:

• Maintaining required financial-services licences and authorisations.
• Complying with applicable credit and financial-services obligations.

• Determining call-recording requirements and honouring opt-out requests.
• Updating lead and application outcomes and reviewing AI outputs.
• Preventing misuse of the system and paying third-party advertising and software costs where applicable.

BuildFocus Digital does not assume the brokerage’s professional, licensing or regulatory responsibilities.

12. Artificial Intelligence and Automation Limitations

AI and automated systems may:

• Misunderstand speech, mispronounce names or misclassify an answer.
• Produce an incomplete transcript or generate an inaccurate summary.
• Experience latency, transfer failure or integration errors.
• Be affected by poor call quality or third-party outages.

Accordingly:

• AI outputs require reasonable human supervision and clients must review important outcomes.
• AI should not be relied upon to make lending, credit, legal or financial decisions.
• BuildFocus Digital may modify workflows to improve accuracy and safety.
• No AI system is error-free.

13. Third-Party Platforms

The website and services may rely on third parties for CRM, hosting, forms, telephony, SMS, email, calendar booking, AI processing, call recording, analytics, advertising, payments and automation.

• Third-party services have their own terms and policies.
• Availability, prices and features can change.
• Platforms may suspend or reject accounts, numbers, messages or integrations.
• BuildFocus Digital cannot guarantee uninterrupted third-party services.
• The client may need to accept separate third-party terms.

14. Intellectual Property

• Training resources, proprietary methods and pre-existing software and materials.

Ownership of custom client materials may be defined in the separate service agreement. BuildFocus Digital does not claim ownership over a client’s existing trademarks, customer data or materials.

15. User-Submitted Materials

Users retain ownership of information and materials they lawfully provide. Users grant BuildFocus Digital permission to use submitted materials only as reasonably required to:

• Respond to the enquiry, provide the demonstration and evaluate suitability.
• Prepare a proposal and provide contracted services.
• Troubleshoot systems and meet legal and operational obligations.

Users confirm they have authority to provide submitted materials.

17. Prohibited Conduct

• Loan settlements, revenue, profit, return on advertising spend, business growth or regulatory approval.

Outcomes depend on factors outside BuildFocus Digital’s control, including lead source, lead quality, lead volume, finance product, offer, market conditions, broker availability, response process, call script, qualification criteria, application process, advertising budget, client follow-up, third-party platforms and applicant circumstances.

Any case-study data must be treated as historical information, not a promise of future performance.

20. Warranties and Disclaimers

The website and demonstration are provided on an “as available” basis to the extent permitted by law. These Terms do not attempt to exclude rights that cannot legally be excluded. BuildFocus Digital does not warrant that:

• The website will always be available or contain no minor errors.
• Every AI output will be accurate or every demonstration will connect.
• Every integration will be compatible or the service will meet every user’s requirements.
• Third-party systems will remain unchanged.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified.

21. Limitation of Liability
